Buying or selling your home or investment property will be one of the most important financial decisions you will make.
We recommend that you seek our advice before you sign any contract so that you can be confident that no unexpected costs or problems arise.
There are standard conveyancing contracts used by Real Estate Agents. Do not be put off from seeking your lawyer’s advice before you sign by the Agent telling you it is all standard. Your particular circumstances may mean that special conditions are needed. You may need to sell your existing home first.
We recommend that you seek an independent valuation of the property before you sign the contract especially if you are buying in an unfamiliar area or it is your first purchase.
There are special points for townhouse and unit buyers. You should ensure that you check the annual body corporate contributions and check that there are no defects in the common property. You should also check body corporate records to see if there are ongoing disputes between owners or court actions by third parties against the body corporate.
When buying, we will check the title and plan of the land for easements or other encumbrances, do the usual searches and inform you if any of the searches disclose problems affecting the property, prepare all necessary documents and attend settlement to ensure you receive good title to the property you are buying.
When selling, we will check all the documents to ensure they are correctly completed and signed, talk to you about the inclusions or exclusions of fittings or fixtures on the contract, make sure you have installed a compliant smoke alarm, liaise with your mortgagee to release your mortgage (if any) and attend settlement to ensure you receive the correct proceeds of sale.
